TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

10.4 Maximum Liability

Our total liability to you for all claims shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

This indemnification obligation will survive termination of these Terms and your use of the Service.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

12.2 Jurisdiction

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to personal jurisdiction and venue therein.

If you are accessing the Service from outside the United States, you are responsible for compliance with local laws in your jurisdiction.

13. Dispute Resolution

13.2 Arbitration Agreement

You agree that any arbitration or legal proceeding shall be limited to the dispute between you and QuizMaster individually. You waive any right to participate in class action lawsuits or class-wide arbitration.

Nothing in this section prevents either party from seeking emergency injunctive relief in court to prevent irreparable harm.

14. Changes to Terms

14.1 Right to Modify

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the Service or by email.

Material changes will take effect 30 days after notice is provided. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, or government actions.

15.6 Survival

Provisions that by their nature should survive termination (including intellectual property, indemnification, and limitation of liability) will survive termination of these Terms.
